Assistant Registrar – 02

Eligibility : (a)(i) holding the analogous post on regular basis or(ii) with eight years regular service in the post in the scale of Rs.5500-9000 (pre-revised). (b)
Possessing degree in Law and minimum 5 years experience of Judicial/Legal work preferably in relation to Customs & excise matters.

Senior Private Secretary – 03

General Instructions:
1. EveryMemorandum of appeal required to heard by a two-Member Bench shall be filedin quadruplicate and shall be accompanied by four copies, one of which shall bea certified copy of the order appealed against in the case of an appeal againstthe original order passed by the additional Commissioner or Commissioner ofExcise or Customs and where such an order has been passed it appeal orrevision, four copies (one of which shall be a certified copy) of the order passed in appeal or in revision and four copies of the order of the original authority.

2. In an appeal filed under the direction of the Collector or the Administrator orthe Central Board of Excise and Customs, one of the copies of the orderappealed against shall be an attested copy instead of a certified copy. In the case of an appeal which can be heard by a single Member,Memorandum of appeal shall be filed in triplicate and number of copies of the order shall be three instead of four.

3. TheTribunal may, in its discretion, on sufficient cause being shown, accept amemorandum of appeal which is not accompanied by the documents referred toin rule 9 or is in any other way defective, and in such cases may require theappellant to file such documents or, as the case may be, make the necessary amendments within such time as it may allow.

4. The President may in his discretion authorise any officer of the Tribunal toreturn any memo of appeal, application or document(s) which is / are not inaccordance with the Customs, Excise and Service Tax Appellate Tribunal(procedure) Rules, 1982. The Officer so authorised may, however, allow the documents to be refiled after removal of the defects in the specified time.

5. The President may in his discretion direct by a general or special order thatonly such documents as may be specified by him in his order may be initially filedwith the appeal; and the paper book as prescribed in sub-rules (1) and (2) maybe filed subsequently on receipt of notice of hearing of the appeal by way of a general or specific notice for the case (s) or advance cause list.

About the organization:
The Customs, Excise and Service Tax Appellate Tribunal* (CESTAT) was formerly known as Customs, Excise & Gold (Control) Appellate Tribunal (in short CEGAT), was constituted on the 11th October 1982, and will be completing 25 years of its existence shortly. During this period procedure for dealing with various aspects of the Tribunal’s work have been evolved. These are partly based on the procedures adopted by the Income-tax Appellate Tribunal, partly on those of the High Court, and partly based on this Tribunal’s own needs and experiences. The CESTAT has brought out a comprehensive Manual, which contains a number of office orders prescribing procedures governing, filing and hearing of appeals, which have been issued from time to time. In this Office Manual an attempt has been made to set out systematically all-important aspects of CESTAT procedure, taking into account existing orders, and filling gaps wherever there are no specific orders.CESTAT was created to provide an independent forum to hear the appeals against orders and decisions passed by the Commissioners of Customs and Excise under the Customs Act, 1962, Central Excise Act, 1944, Finance Act 94 relating to Service Tax. The Tribunal is also empowered to hear the appeals against orders passed by the designated authority with regard to Anti Dumping Duties under the Customs Tariff Act, 1975. The sanctioned strength of the Members (including President and two Vice Presidents) is 21.It has 3 benches in Delhi and 4 benches in Mumbai and one each at Kolkata, Chennai and Banglore. Each Bench consists of a Judicial Member and a Technical Member. With a view to have expeditious disposal of small cases, a Bench of Single Member deals with the matters not exceeding Rs.10 Lakhs is also constituted. Except in the matters relating to classification and valuation of goods, the Tribunal is the final Appellate Authority though a reference to the High Court can be made on a question of Law. In classification and valuation matters, the appeal against the order of the Tribunal lies only to the Hon’ble Supreme Court.The CESTAT strives to dispose off the appeals as early as possible and deliver the Judgments within well defined time frame. To have a transparency in the system, computerization of CESTAT is underway.
